Terms and Conditions
ARATOURS GmbH trading as Switzerland Tour (hereinafter called the “Company”) represents below Terms and Conditions. By confirming any travel service through switzerland-tour.com you affirm, that you have considered and accepted our Company’s Terms and Conditions: the Company shall not be liable for any errors or omissions that may happen, if you ignore getting acknowledged with it. If you will have a question, a concern or need an explanation, please, contact our customer service team for assistance.
The Company may alter Terms and Conditions from time to time, therefore, you should check the new version of it on our website www.switzerland-tour.com regularly.
The Company shall endeavor to act in good will and make all efforts within its competence to ensure an enjoyable and safe journey, which fully meets clients’ expectations.
While booking any travel service through our company for a group, the contact person confirms that he/she is authorized to accept the Company’s terms and conditions on behalf of everyone named in the booking.
You need to check all the details in the booking summary and advise us in case you find any inconsistency with the real facts provided by you earlier: kindly consider that changes done later on may incur charges or be not possible (for more information refer to points of “Changes” and “Cancellations”).
Client will receive final confirmation of the booking, after the full payment is done. When the booking is confirmed the client will receive all travel documents.
Scope of these Terms and Conditions
The following terms and conditions are considered to be a contract between the customer and ARATOURS GmbH, which come into force once the Company has received your electronic or written booking request.
These terms and conditions do not apply to bookings of flights, train / bus tickets or any other transportation means: these entities are regulated by their own terms and conditions.
The Company reserves the right to alter prices shown in our brochures and website any time such changes are required: the customer will be advised about the current final price at the time of confirmation of the booking. The static prices for tours and excursions can be found in EUR currency on the official website of www.switzerland-tour.com. The package prices can be paid by Swiss Francs (CHF) as well, which are subject to change due to exchange rate fluctuations.
Be informed that for all the tours and excursions you are advised about the scope of services included in the price, if you require more than the mentioned ones, contact our agents.
The Company reserves the right to change rates in the website, leaflets or brochures in about which you will be informed by the travel agent before signing the contract.
The price increase can be caused but not limited to some points mentioned below:
- Increase in transportation cost (including fuel)
- Introduction of new taxes (Airport charge, VAT etc.)
- Exchange rate fluctuations
- The Company reserves right to make program changes (airlines, flights, transport, accommodation etc.) in certain unforeseen circumstances that may occur during the trip, taking into consideration unfavorable weather or other force majeure cases. The Company will make a refund in case the price for the revised services will be lower than the original price.
Payment Methods: The Company accepts all widely used payment methods such as Credit Card (for security reasons we are eager to send you a secure payment link, so that you will not have to provide your CC details online), bank transfer and PayPal or Cash payment (only for excursions). In providing payment details you warrant that you have authority to use the card and authorize the Company to withdraw the amount.
In case of cash payment bookings, the Company requires credit card details only to secure your booking: the Company will be authorized to withdraw the amount from the card, if you fail to use the service and do not acknowledge us about it. Choosing cash payment type, please, ensure that you have the correct amount available, unless otherwise stated in your booking voucher.
Deposit Payment: For tours as well as excursions a deposit payment of at least 50% is compulsory (depending on the specific tour or excursion, your travel agent will let you know the exact amount of deposit payment). In case the customer fails to make the payment within the predetermined time, the Company is entitled to cancel the pending trip and claim cancellation fee.
Final Payment: Your booking will be finally confirmed only after the Company receives the full payment for the requested tour (Travel documents will be sent to you after the booking confirmation). In case of delayed final payment, we are entitled to cancel the tour and claim cancellation fee.
Changes in Confirmed Tours or Excursions
If you would like to make any changes in already confirmed tour / excursion, then you need to notify your travel agent in written form. Consider that requested changes may cause both administration fee as well as certain amount of extra cost from other service providing company (be it a hotel, transportation company or something else). The Company will do its best to meet your needs and make changes accordingly, but we regret that in some cases it will not always be possible.
Changes are acceptable at least 10 days before the departure date in case of confirmed tours.
Changes are acceptable at least 24 hours before the departure date in case of confirmed excursions.
Cancellation and Rebooking
To cancel already confirmed tour / excursion the Company will require written consent from the customer.
In case of tours, the Company will charge the customer not only the cancellation fee, but also the service fee from the total cost of the trip as per below-mentioned schedule:
- From 16 to 30 days before departure: 40%
- From 7 to 15 days before departure: 60%
- From 2 to 6 days before departure: 80%
- From 1 to 48 hours before departure: 100%
In case of you cancel already confirmed excursion, then the following fees will be applied:
- Up to 48 hours before departure: 20%
- Up to 24 hours before departure: 50%
- Less than 24 hours: 100%
Be informed that the last indicated date in your written request will be considered as a base for calculation of costs caused by cancellation or rebooking.
If you have cancellation insurance, then the cancellation charges will be paid by the respective insurance company.
The insurance is not included in the package price, however, as per client’s request the Company will make all necessary arrangements with the insurance company and inform about the additional charges and specifications to the customer.
Air Travel Arrangements
The Company cannot take the responsibility if an airline reschedules, varies or cancels the booking. If the customer has taken the ticket through our company, then, we will try to assist by all means in making new flight arrangements with possibly best solutions.
It is the client’s responsibility to catch the flight / connection flight on time, no refunds will be provided by the Company for the missed trips due to rescheduled, canceled or delayed flights after airport check-in.
The client will receive all the travel documents after the full payment and booking confirmation. Travel documents will be sent to the client on an electronic form, however, hard copies will also be available upon request.
Visas and Passports
It is the client’s responsibility to have a valid passport: it is recommended to have valid passport at least 6 months beyond the end of the trip as well as have a minimum of three blank pages.
The client is responsible for obtaining and paying for all visa and other entry documents required by laws and regulations of Switzerland.
The Company cannot take liability for any traveler, who will not get a visa due to presented incorrect documentation.
The clients are required to declare about the luggage dimensions, they will carry on during the trip, thus, that the Company can quote a relevant price. Kindly consider that size and weight allowance differ from airline to airline.
Emergency Contact Details
All the clients need to provide the Company with an emergency contact details, thus, we can contact the friends or family members in case of any emergency.
Laws and Regulations
The following terms and conditions are being regulated by the Swiss laws and regulations.
ARATOURS GmbH Liabilities and Responsibilities
If the Company fails to comply with these terms and conditions, then it is responsible only for loss or damage caused to you because of the breach and negligence. Hence, a refund will be made as per the caused damage by the Company. We are not liable for accidents, which occur during the provision of the service such as illnesses, injuries or death, unless it is caused by our negligence. Kindly note, that it is your responsibility that reasonable care was not used.
In the event of force majeure situations such as war, epidemics, natural disasters, military operations, etc., the effects and consequences of which cannot be reasonably mitigated or prevented, as well as delays and deviations caused by weather conditions (heavy rains, thunderstorms, fires, etc.) or public services (changes in the schedule of air transport and railway), the Company reserves the right to cancel or make changes in the travel arrangements.
The Company has no responsibility for the eventuality of missed flights or connections due to bad weather conditions, traffic congestion, road accidents, acts of terrorism and vandalism.
The Company provides no warranty to access all the public sites during a tour. As Switzerland, an attractive destination for tourists from around the world and all the attractions could be crowded.
If the Company does not have the necessary minimum number of tour or excursion participants, we reserve the right to cancel the trip.
In rare cases, if we cancel the booking, the Company shall notify the Client at the earliest possible date and refund all the amounts that have been prepaid to us or seek to offer you an equivalent replacement of your trip or excursion.
It is your responsibility to provide full and correct information while making a booking and notify the Company in case of any alterations in the details, that you have previously provided.
Hereby you authorize us that the Company is entitled to charge the card for any damage incurred during the transfer by your fault.
Parents or chaperons (or friends over 18 years) of children and adolescents under the age of 18 years are responsible for the conduct of the minors during the trip.
The Company shall not be liable for any delays, changes or service cancellations due to force majeure, or to other circumstances that are unforeseeable or beyond the service provider control, such as accidents suffered by the third parties on the transfer route, police checkpoints, acts of terrorism, extreme weather conditions etc.
Disputes and Limitation of Damages
In the event of a dispute, the Company and the Client shall endeavor to seek an amicable and faithful agreement. If the parties fail to reach such an agreement, the dispute shall be referred to a mediator. However, if the mediation is also unsuccessful, the case of dispute shall be referred to a formal litigation process in the courts of Fribourg, Switzerland.
If the service quality does not meet your expectations, you are strongly encouraged to inform us about it in written form sending us an e-mail with corresponding evidence confirming the loss and damage. After the receipt of your complaint with supporting documents, ARATOURS GmbH will take the necessary steps to compensate your loss or damage.
